Legal & compliance
Website Terms of Use
The standards that govern access to RockGlobal websites, content, tools, and public digital services.
Clear rules for using RockGlobal online. These Terms explain permitted Website use, protect RockGlobal content and systems, and identify the rules that apply across each operating route.
These Website Terms of Use (Terms) govern access to and use of the RockGlobal public websites, webpages, content, tools, forms, widgets, downloads, and other online resources that link to these Terms (together, the Website).
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website. These Terms concern the Website only. Trading accounts, financial products, platforms, applications, promotions, partner arrangements, and other services may be governed by separate agreements and disclosures.
Terms at a glance
- The Website provides general information and is not personal financial, investment, legal, tax, or accounting advice.
- Market information may be delayed, indicative, incomplete, or out of date and must not be used as the sole basis for a trade or investment decision.
- You may use the Website only for lawful, personal, or legitimate business purposes and in accordance with these Terms.
- Scraping, unauthorised automation, interference, reverse engineering, security circumvention, and misuse of RockGlobal systems or content are prohibited.
- RockGlobal owns or licenses the Website, its design, branding, copy, graphics, software, and proprietary data.
- Separate product terms, client agreements, risk disclosures, privacy notices, and local laws may also apply.
- The RockGlobal entity and governing law applicable to you depend on the route through which the Website is made available.
1. About RockGlobal and these Terms
RockGlobal is a brand used by separate legal entities. In these Terms, RockGlobal, RG, we, us, and our mean the RockGlobal entity responsible for the Website route you are using. You and your mean each person who accesses or uses the Website and, where that person acts for an organisation, that organisation.
These Terms form a binding agreement between you and the applicable RockGlobal entity. Your route is normally identified by the domain or regional path you visit, the jurisdiction selector, the Website footer, a notice shown to you, or an existing RockGlobal agreement. If no route is identified and you do not have an existing RockGlobal relationship, the Website is administered through the international route, subject always to any mandatory law that applies where you are located.
| Website route | Responsible RockGlobal entity | Registration details |
|---|---|---|
| International | RockGlobal International LLC | Company No. 3108 LLC 2023, registered in Saint Vincent and the Grenadines |
| Australia | ROCKGLOBAL CAPITAL MARKETS PTY LTD | ABN 12 108 915 233; Australian Financial Services Licence No. 282288 |
| New Zealand | Rockfort Markets Limited, trading as RockGlobal | NZBN 9429042010807; FSP509766 |
Each entity is responsible only for its own acts, omissions, Website route, and contractual relationships. Nothing on the Website creates a partnership, joint venture, or general agency between the RockGlobal entities, and no entity assumes another entity's obligations merely because they use a common brand or technology.
For the New Zealand route, registration on the Financial Service Providers Register does not itself mean that Rockfort Markets Limited is licensed or actively supervised for every financial service. Refer to the relevant service disclosure and public register entry for current status and permitted services.
2. Other terms and document priority
These Terms should be read with the RockGlobal Privacy Policy, Cookie Notice or consent tool, risk warnings, product disclosures, website notices, and any terms presented for a feature you use.
If you apply for, open, or operate an account or use a trading platform, your client agreement, terms of business, product disclosure statement, financial services guide, risk disclosure, execution policy, promotion rules, or other service-specific document may also apply. If there is an inconsistency:
- the service-specific document governs the relevant account, product, transaction, platform, or promotion;
- these Terms govern general access to and use of the public Website; and
- mandatory law prevails to the extent it cannot lawfully be varied or excluded.
Website content does not amend a client agreement unless an authorised RockGlobal notice expressly states that it does so.
3. Eligibility and authority
You may use the Website only if you have legal capacity to agree to these Terms. The Website and RockGlobal financial services are intended for adults aged 18 years or older, or the age of legal majority where you live if higher.
If you use the Website for a company, partnership, trust, or other organisation, you represent that you are authorised to act for it and bind it to these Terms. References to you then include that organisation.
You must not access or use a restricted part of the Website if you are prohibited from doing so by law, regulation, sanctions, court order, employment duty, contract, or a RockGlobal restriction. You are responsible for understanding the laws that apply to you.
4. Website availability and territorial restrictions
The Website is directed only to persons in jurisdictions where its publication and use are lawful. Website availability does not mean that every RockGlobal product, service, instrument, promotion, or account type is available or permitted in every location.
We may use location information, domain routing, eligibility questions, or other controls to present relevant content or restrict access. You must not use a virtual private network, proxy, false address, false declaration, or other method to evade a geographic, legal, eligibility, or product restriction.
RockGlobal may change, suspend, withdraw, restrict, or discontinue any part of the Website at any time, including for maintenance, security, legal, operational, or commercial reasons. Where reasonably practicable, we may give notice of a material planned interruption, but we do not promise continuous availability.
5. General information only
Unless expressly stated otherwise in a regulated disclosure, Website content is provided for general information and educational purposes only. It does not take into account your objectives, financial situation, needs, knowledge, experience, tax position, or risk tolerance.
Nothing on the Website is personal financial advice, investment advice, a personal recommendation, legal advice, tax advice, accounting advice, or a guarantee of outcome. Nothing is an offer, solicitation, invitation, inducement, or recommendation to acquire or dispose of a financial product where doing so would be unlawful.
You should assess whether information, a product, or a service is appropriate for you and obtain independent professional advice where needed. Do not rely on Website content as a substitute for the official terms, disclosures, specifications, confirmations, statements, or records applicable to a service or transaction.
6. Trading risk and market information
Trading leveraged or complex financial products involves significant risk and may not be suitable for everyone. Losses can occur rapidly and may equal or, where the applicable product terms permit, exceed amounts deposited. Past performance, simulations, scenarios, forecasts, analyst views, educational examples, and testimonials are not reliable indicators of future results.
Prices, rates, charts, news, calendars, statistics, commentary, instrument details, and other market information displayed on the Website may be obtained from third parties. They may be indicative, delayed, rounded, incomplete, subject to different calculation methods, or affected by latency, market disruption, data-provider error, or technical limitations.
Website market information:
- may differ from executable prices, platform data, confirmations, or official market records;
- may be changed or corrected without notice;
- is not guaranteed to be accurate, complete, current, or available;
- must not be used as the sole basis for placing, modifying, or cancelling an order; and
- must not be redistributed or used to create a competing data product without permission.
Before using a financial service, read the client agreement, risk warning, product disclosure, costs and charges information, and other documents for your route. A public Website interruption does not by itself cancel, change, or suspend an order, position, margin obligation, or account instruction.
7. Limited permission to use the Website
Subject to these Terms, RockGlobal grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable permission to access and use the Website for lawful personal use or legitimate internal business evaluation.
You may print or save reasonable extracts for your own records provided that you do not remove proprietary notices, change the content, imply RockGlobal endorsement, or use the material commercially. No other right or licence is granted by implication, estoppel, or otherwise.
We may revoke this permission if you breach these Terms, create legal or security risk, or misuse the Website. Revocation does not limit any other right or remedy.
8. Acceptable use
You must:
- use the Website lawfully, fairly, and only for its intended purposes;
- provide accurate and non-misleading information when submitting a form or enquiry;
- respect access controls, rate limits, instructions, copyright notices, and technical restrictions;
- use reasonable security practices and keep any credentials, verification codes, or private links confidential;
- promptly tell RockGlobal if you discover suspected unauthorised access, a security vulnerability, or misuse involving the Website; and
- cooperate with reasonable steps to investigate or prevent fraud, cyber incidents, legal breaches, or harm.
If RockGlobal provides written integration instructions, a documented API, a partner feed, or other authorised automated access, you may use it only within its separate credentials, limits, documentation, and agreement.
9. Prohibited activities
You must not, directly or through another person, device, script, or service:
- break any applicable law, regulation, sanctions restriction, court order, intellectual property right, privacy right, or contractual obligation;
- access or attempt to access a system, account, area, data set, endpoint, source file, administrative function, or credential that you are not authorised to access;
- probe, scan, test, exploit, or circumvent authentication, security, access control, geographic restriction, rate limit, robot exclusion instruction, or technical protection without prior written authorisation;
- introduce malware, malicious code, corrupted data, ransomware, spyware, a logic bomb, or another harmful component;
- disrupt, overload, degrade, flood, attack, or interfere with the Website, its infrastructure, a provider, or another user's access;
- scrape, crawl, spider, index, harvest, monitor, mirror, cache, or extract Website content or data by automated means, except for a conventional search engine acting in accordance with published robot instructions or as RockGlobal expressly authorises in writing;
- use bots, macros, automated trading systems, headless browsers, form submitters, or similar tools to interact with public quote widgets, calculators, promotions, onboarding flows, support channels, or other Website features without authorisation;
- treat access to a trading platform or authorised API as permission to automate the public Website, or use the public Website as an undocumented market-data or execution interface;
- copy, frame, reproduce, modify, translate, adapt, decompile, disassemble, reverse engineer, derive source code from, or create derivative works from any Website software or component, except to the limited extent a law expressly permits and does not allow that right to be excluded;
- remove or alter a copyright, trademark, attribution, watermark, rights-management notice, risk warning, legal notice, or source identifier;
- impersonate RockGlobal or another person, misrepresent your identity or authority, create a false affiliation, use lookalike branding or domains, or make a misleading statement about RockGlobal;
- collect personal information from the Website, send spam or unsolicited promotions, or use Website contact details for unlawful marketing;
- upload or transmit content that is unlawful, fraudulent, defamatory, threatening, discriminatory, obscene, infringing, deceptive, or harmful;
- use Website content, data, or infrastructure to train, benchmark, validate, or operate a commercial model, artificial-intelligence system, competing service, or data product without written permission; or
- help, encourage, conceal, or attempt any prohibited activity.
Security research is permitted only under a written vulnerability-disclosure or testing authorisation issued by RockGlobal. If you encounter a potential vulnerability, stop testing and report it without accessing, retaining, changing, or disclosing unnecessary data.
10. Forms, accounts, and communications
Some Website features may allow you to submit an enquiry, request a call, register interest, begin an application, subscribe to communications, or connect to a secure portal. You must not submit false, incomplete, misleading, infringing, or malicious information.
You are responsible for activity carried out using credentials or access links issued to you, except to the extent the activity results from RockGlobal's failure to comply with a duty that cannot be excluded. Notify the relevant RockGlobal route promptly if credentials, verification methods, or devices may be compromised.
Electronic communications can be delayed, intercepted, corrupted, or sent to the wrong address. Do not use an ordinary Website form or email to send passwords, full payment-card details, private keys, unnecessary identity documents, or urgent trading instructions. A message is not received or accepted merely because your device shows it as sent.
Submitting a form does not guarantee account approval, product access, execution, support response time, or acceptance of an instruction.
11. Intellectual property rights
The Website and its content are owned by or licensed to RockGlobal and are protected by copyright, trademark, design, database, confidential-information, and other intellectual property laws.
Protected material includes the RockGlobal name and logos, trading names, domain names, page layouts, visual design, user interfaces, copy, graphics, icons, photographs, video, audio, downloads, reports, educational material, software, code, models, calculations, compilations, instrument taxonomies, and proprietary or licensed data.
You must not use a RockGlobal trademark, brand asset, design element, or confusingly similar identifier without prior written permission. You must not suggest sponsorship, endorsement, partnership, regulatory status, or affiliation where none exists.
Third-party names, marks, and content remain the property of their respective owners. Their appearance does not necessarily imply endorsement by RockGlobal or endorsement of RockGlobal by them.
12. User submissions and feedback
You retain ownership of content you submit through the Website. You grant the relevant RockGlobal entity a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, adapt, and use that content to operate the Website, respond to you, provide requested services, maintain security and records, and comply with law. This licence lasts for as long as reasonably necessary for those purposes.
You represent that you have the rights and permissions needed to submit the content and that our permitted use will not infringe another person's rights. Do not submit confidential information belonging to another person unless you are authorised to do so.
If you voluntarily provide an idea, suggestion, or general product feedback that is not confidential, RockGlobal may use it without restriction or payment. This does not give RockGlobal ownership of your personal information, which is handled under the Privacy Policy.
RockGlobal may remove, quarantine, preserve, or disclose submitted content where reasonably necessary to operate the Website, enforce these Terms, investigate misuse, protect rights or safety, or comply with law.
13. Third-party content, links, and services
The Website may display or link to third-party websites, platforms, applications, data, research, news, social networks, payment services, downloads, or advertisements. Links are provided for convenience and context. Unless expressly stated, RockGlobal does not control, endorse, sponsor, or assume responsibility for third-party content or services.
Third parties apply their own terms, privacy practices, security controls, availability standards, and fees. Review them before using a third-party service or providing information. RockGlobal is not responsible for loss caused solely by a third party outside RockGlobal's reasonable control, but nothing in these Terms excludes responsibility that applicable law places on RockGlobal.
If you follow a link away from the Website, you do so at your own discretion. A link does not mean the linked information is complete, current, suitable, or available in your jurisdiction.
14. Website changes, maintenance, and security
We may update Website content, features, technical requirements, domains, or availability without notice. Content may become inaccurate or out of date between reviews. We are not obliged to maintain historical Website material unless law or a separate agreement requires it.
RockGlobal uses reasonable measures designed to protect the Website, but no internet service is completely secure or error-free. We do not guarantee that the Website will be free from vulnerabilities, malware, harmful third-party interference, transmission failure, or incompatibility with your device.
You are responsible for using current software, appropriate security controls, reliable connectivity, and independent backups. You should verify important information through official documents or an authorised RockGlobal contact before relying on it.
15. Privacy and cookies
Our Privacy Policy explains how RockGlobal collects, uses, holds, shares, transfers, and protects personal information. The Cookie Notice or consent tool describes relevant cookies and similar technologies and, where applicable, provides choices.
By using the Website, you acknowledge that internet communications and technical logs may involve processing across jurisdictions. Where consent is legally required for a cookie or similar technology, the relevant consent mechanism governs that processing; these Terms do not replace or manufacture consent.
Do not attempt to identify an anonymous user, combine Website information to profile individuals unlawfully, or interfere with another person's privacy choices.
16. Disclaimer of warranties
To the maximum extent permitted by law, the Website is provided as is and as available. RockGlobal does not promise that the Website or any content will be uninterrupted, error-free, secure, accurate, complete, current, suitable for a particular purpose, compatible with every device, or free from harmful components.
To the maximum extent permitted by law, RockGlobal excludes warranties, representations, guarantees, conditions, and duties that are not expressly stated in these Terms. This includes implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement where they may lawfully be excluded.
Nothing in these Terms excludes, restricts, or modifies a guarantee, right, remedy, condition, warranty, or liability that cannot lawfully be excluded, restricted, or modified, including applicable rights under the Australian Consumer Law or New Zealand consumer and fair-trading legislation.
17. Limitation of liability
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
Subject to that sentence and to the maximum extent permitted by law, RockGlobal is not liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from or connected with the Website. This includes loss of profit, revenue, opportunity, goodwill, anticipated savings, data, business interruption, or trading loss, whether arising in contract, tort, negligence, statute, or otherwise, and whether or not the possibility was known.
RockGlobal is not liable for loss arising solely from:
- reliance on general, indicative, delayed, incomplete, or out-of-date Website information;
- a third-party website, service, data source, device, network, or event outside RockGlobal's reasonable control;
- your breach of these Terms, unlawful conduct, security failure, or failure to follow an official product document or authorised instruction; or
- Website maintenance, suspension, withdrawal, or a change that RockGlobal makes reasonably for security, legal, operational, or commercial purposes.
Where RockGlobal's liability for a Website service cannot be excluded but may lawfully be limited, that liability is limited, at RockGlobal's option, to supplying the relevant service again or paying the reasonable cost of having it supplied again. This limitation applies only where it is fair and legally permitted.
The exclusions and limitations in this section are intended to operate independently. They do not alter any liability allocation, margin obligation, compensation right, complaint pathway, or limitation contained in a service-specific agreement.
18. Responsibility for breach and indemnity
To the maximum extent permitted by law, you are responsible for reasonably foreseeable loss, damage, cost, or third-party claim that RockGlobal incurs directly because you:
- materially breach these Terms;
- use the Website unlawfully or fraudulently;
- infringe another person's intellectual property, privacy, confidentiality, or other rights through content you submit; or
- deliberately compromise or interfere with Website security or availability.
Where legally permitted, you must reimburse RockGlobal for that loss, damage, cost, or claim after RockGlobal gives reasonable details and allows you a reasonable opportunity to respond. You are not responsible under this section to the extent the matter was caused by RockGlobal's negligence, wilful misconduct, breach of law, or failure to take reasonable steps to mitigate loss.
This section is not intended to impose liability on a consumer where doing so would be unfair or prohibited by law.
19. Suspension and termination
RockGlobal may restrict, suspend, block, or terminate your access to all or part of the Website where we reasonably believe this is necessary to:
- respond to a breach or suspected breach of these Terms;
- protect users, systems, data, rights, or Website availability;
- prevent fraud, unlawful conduct, sanctions exposure, or security risk;
- comply with law, regulation, a court order, or an authorised request; or
- manage the withdrawal or material change of the Website.
Where appropriate and lawful, we may give notice and an opportunity to remedy a breach. We may act immediately where delay could create harm, security risk, legal exposure, or continued disruption.
You may stop using the Website at any time. Provisions concerning intellectual property, user submissions, disclaimers, liability, responsibility for breach, governing law, and provisions intended by their nature to survive will continue after access ends.
Termination of Website access does not by itself close a trading account, cancel an order, end a client agreement, or satisfy an outstanding obligation. Those matters are governed by the applicable service terms.
20. Governing law and resolving concerns
The governing law and courts depend on your Website route, subject to any mandatory law or right to bring a claim elsewhere that cannot lawfully be excluded.
| Website route | Governing law | Courts |
|---|---|---|
| International | Laws of Saint Vincent and the Grenadines | Courts of Saint Vincent and the Grenadines |
| Australia | Laws of New South Wales, Australia | Courts of New South Wales and applicable courts of the Commonwealth of Australia |
| New Zealand | Laws of New Zealand | Courts of New Zealand |
Before starting court proceedings concerning general Website use, you and RockGlobal should make reasonable efforts to resolve the concern informally by contacting the relevant route and providing enough information to investigate. This does not prevent either party from seeking urgent interim relief or exercising a regulatory, complaint, consumer, or statutory right.
RockGlobal may seek injunctive or protective relief in any court with jurisdiction where reasonably necessary to protect intellectual property, confidential information, systems, data, users, or security.
Nothing in this section changes a dispute-resolution process or external complaint scheme that applies under a client agreement or mandatory financial-services law.
21. Changes to these Terms
We may update these Terms to reflect changes in law, regulation, technology, security, Website functionality, our operating structure, or reasonable business needs. The current version will show its effective and last-updated dates.
Material changes will take effect when stated in the updated Terms. Where reasonably practicable or legally required, we will provide additional notice. Changes will not apply retrospectively in a way that removes accrued rights unless law permits and the change is clearly stated.
Your continued use of the Website after updated Terms take effect constitutes acceptance of those Terms. If you do not agree, stop using the Website. Separate procedures apply to changes to client agreements and regulated service documents.
22. General provisions
If a provision of these Terms is held unlawful, invalid, or unenforceable, it will be read down to the minimum extent necessary or severed, and the remaining provisions will continue in effect.
If RockGlobal delays or does not enforce a provision, that does not waive the provision or any later breach. A waiver must be clear and authorised in writing.
You may not assign or transfer your rights under these Terms without RockGlobal's prior written consent. RockGlobal may assign or transfer its rights and obligations as part of a genuine restructure, merger, sale, regulatory transfer, or transfer to an affiliate or successor, provided this does not reduce a mandatory right or materially disadvantage you contrary to law.
These Terms and the documents expressly incorporated into them constitute the agreement concerning general Website use. They do not replace service-specific agreements. Except for a RockGlobal entity entitled to enforce rights expressly granted to it, a person who is not a party has no right to enforce these Terms unless mandatory law provides otherwise.
Headings are for convenience and do not affect interpretation. Including and similar words are illustrative and do not limit the words before them. A reference to law includes amendments and replacements. An electronic version of these Terms has the same effect as a printed version to the extent permitted by law.
23. Contact us
Questions, notices, and reports about these Terms or Website use should identify the relevant domain, route, page, date, and issue. Do not include passwords or unnecessary identity documents.
